Mandated and Make Available Benefits - Commercial, HMO & Article 43 Insurance Contracts

Definition of Infertility

The American Society for Reproductive Medicine (ASRM) is a voluntary, non-profit organization devoted to advancing knowledge and expertise in reproductive medicine, including infertility, menopause, contraception, and sexuality. From time to time, ASRM’s Practice Committee offers guidance to physicians and health professionals on the various conditions related to reproductive medicine. In June of 2008, the ASRM’s Practice Committee published a Practice Committee Report wherein it modified its definition of infertility.

Insurance Law, Sections 3221(k)(6) and 4303(s) provide mandated coverage for certain conditions related to infertility and link the definition of infertility to the standards and guidelines established and adopted by ASRM. Insurers are reminded that polices containing benefits in compliance with the above cited sections shall use a definition of infertility no less favorable than the standards and guidelines established and adopted by ASRM.
