Property/Casualty Insurance Data Calls

The following table provides basic information on, and links to, the periodic data calls of the Property Bureau. 

Be sure to use the most current Survey: Don't complete a report that is out of date. For instance, do not complete the 2020 Insurance Availability Survey and Annual Free Trade Zone Update for submission in 2021. 

Be sure you are required to file: Don't complete reports you are not required to submit. If, after reading the information in the "Who Must File" section, you are not sure if you must file refer questions to the individuals listed as Contacts for each report.

New York Medical Malpractice Insurance Plan

Cite: Section 308 of the Insurance Law

Who Must File: New York licensed companies writing Medical Malpractice on a direct basis are required to respond to this data call. These companies should receive a survey email from the Department requesting their participation. If your company writes Medical Malpractice business and has not received this survey, please contact us.

Due Date: April 29, 2024

Purpose: To determine companies to be included in the New York Medical Malpractice Insurance Plan and to determine, among other items, their proportionate voting rights and share of the writings, expenses, servicing allowance, capital charges, management fees and losses of the Plan.

Data Call for Private Passenger Automobile Insurance

Cite: Section 337 of the New York Insurance Law

Who Must File: Selected New York licensed companies writing private passenger automobile business are required to respond to this data call. These companies will receive a survey email from the Department requesting their participation. If your company does not receive such a direct request, it is not required to submit any information.

Due Date: March 29, 2024

Purpose: To assist in maintaining updated information on the Department’s website “Consumer Information – Auto Insurance”.

Annual Availability Survey, (including Free Trade Zone Report & Special Homeowners Insurance Supplement) - 2023 

Cite: Section 308 of the Insurance Law

Who Must File: All Licensed Property/Casualty Insurance Companies

Due Date: December 29, 2023

Purpose: Insurance Available Survey: To determine market capacity for difficult-to-place types of insurance.

Free Trade Zone Report: The data gathered from the survey is used in statistical monitoring of lines of business written in the Free Trade Zone, pursuant to Department Regulation 86 (11 NYCRR 16).

Special Homeowners Insurance Coastal Supplement: To obtain current information on homeowners insurance market conditions in New York's coastal region.

Submission: Submissions must now be made through the “Annual Availability Survey (including Free Trade Zone Report & Homeowners Supplement”) application on the DFS Portal. Please note that a separate request for this application must be made through the portal, even if you already have an existing portal account for other report(s).

Professional Medical Malpractice Insurance Reporting Requirements

Cite: Section 315 of the Insurance Law

Who Must File: Only entities writing medical malpractice insurance on a direct basis in New York State (licensed insurers, excess line insurers, risk retention groups and the Medical Malpractice Insurance Plan).

Due Date: Quarterly, one month after the close of the calendar quarter.

Purpose: Reporting requirements of Surcharges, Cancellations and Non-renewals for Medical Malpractice Insurers (filed with the Superintendent and with the Commissioner of Health) which will provide the Department with better information regarding an insurer's loss experience in this area. Submission Email Address: The email address for making submissions has changed effective as of June 2018. Submissions must now be made to DFS at [email protected] and to the Health Department at [email protected]

Prohibition of Geographical Redlining - Annual Reporting Requirements Under Regulation 90 & Circular Letter No. 17 (1996)

Cite: 11 NYCRR 218 (Regulation No. 90)

Who Must File: Licensed Property/Casualty Insurance Companies writing in excess of $500,000 of New York Direct Written Premium in Private Passenger Automobile, Fire, or Fire and Extended Coverage Insurance.

Due Date: Annually, May 1st.

Purpose: To aid the Department in its enforcement of the Prohibition against Geographical Redlining in Writing Private Passenger Automobile and Fire or Fire and Extended Coverage Insurance Policies.

Public Auto Classifications

Who Must File: New York licensed companies writing Public Automobile business are required to respond to this data call. These companies should receive a survey email from the Department requesting their participation. If your company writes Public Automobile business and has not received this survey, please contact us.

Due Date: December 20, 2023

Purpose: To assist the Department in assessing the state of the public automobile insurance market in New York.

Submission: Submissions must now be made through the “Public Auto Classifications NYIL 308”) application on the DFS Portal. Please note that a separate request for use of this application must be made through the portal, even if you already have an existing portal account for other report(s).

Regulation 41 Excess Line Placements

Cite: 11 NYCRR 27 (Regulation 41) Section 27.14

Who Must File: Excess Line Insurers.

Due Date: Annually, March 15.

Purpose: To assist the excess line insurers in filing the required policy details on business written in the excess line market pursuant to Regulation 41.

Submission Email Address: For each calendar year, all excess line insurers are required to file the EL-1 report and Affirmation electronically through New York State Portal System. To use the portal system, an insurer is required to create a portal account and request access to the Excess Line – Upload application.

Regulation 154 Homeowners Insurance Quarterly Reporting Requirements

Please note that the instructions for this report have been updated (2/2021) to clarify reporting of policies that have been cancelled/reinstated.

Cite: 11 NYCRR 19 (Regulation 154) Section 19.4

Who Must File: Licensed Property/Casualty Insurance Companies with New York Direct Written Premium of $500,000 or more of Homeowners Multiple Peril Insurance, for the previous calendar year (i.e. a company that writes this amount in 2021 must file reports for all quarters of 2022).

Due Date: Quarterly, one month after the close of the calendar quarter

Purpose: To study the Homeowners "market dynamics" with respect to the maintenance of the level of homeowners policies written in this State with particular regard to certain defined areas.

Section 3425 Compliance Report (2% Report)

 

Cite: Section 3425(l)(1) of the New York Insurance Law.

Who Must File: Licensed Property/Casualty Insurance Companies writing in the Private Passenger Automobile market.

Note: For insurers which have multiple rating programs approved under §2352 of the NY Insurance Law, a SEPARATE REPORT must be submitted for each such program. These should not be confused with multi-tier rating programs, which are approved under §2349 of the NY Insurance Law and 11 NYCRR 154, and are already addressed under a separate tab in the reporting form.

Due Date: Annually, April 30th

Purpose: The data on rating territories, primary driver classifications, new insureds and nonrenewals is used to prepare a report to the Governor and the Legislature.
