SUBJECT: REIMBURSEMENT RATES FOR HOSPITAL AND HEALTH RELATED SERVICES UNDER NO-FAULT

Pursuant to the provisions of 11NYCRR 68.2 (Regulation 83), on and after January 1, 1978, the schedule of all inclusive daily rates for inpatient hospital services and health related services, including home health services, provided in conformance to Section 671(1)(a) of the Insurance Law shall be the rates approved by the Chairman of the Workers" Compensation Board in accordance with the provisions of Chapter 767 of the Laws of 1977.

Consistent with Circular Letter # 3(1982) in which you were informed that the Insurance Department had not adopted the 6% interim increase in medical providers fees granted by the Chairman of the Workers Compensation Board, you are advised to pay the following fees for the physicians component of the outpatient rate for services rendered by Hospital staff in their outpatient Departments on and after February 15, 1982 until the next annual revision of the Medical Fee Schedules planned for July 1, 1982.

By separate letter this Department is advising all New York State Hospitals to bill at the above fees. Outpatient billings received which contain the 6% interim increase should be adjusted accordingly to the July 1, 1981 level and a denial issued for the disallowed amount.

In compliance with the provisions of Regulation 83 and effective with services rendered on and after January 1, 1982, through December 31, 1982, the attached schedule subject to the above exception for the physicians component of the out-patient rate shall be utilized by no-fault insurers for payment of hospital outpatient and inpatient services.
