TO THE CHIEF EXECUTIVE OFFICERS OF AUTHORIZED PROPERTY AND CASUALTY INSURERS AND ACCREDITED REINSURERS
RE: Reinsurance arranged by Promotora de Occidente S.A. and/or related parties
This Department has received notice of commencement of litigation in Romania by Administratia Aseguradura De Stat (ADAS), whereby it seeks to avoid various reinsurance agreements involving Promotora de Occidente S.A. (POSA) and related parties. Enclosed is a copy of ADAS complaint.
In order to determine the volume of business which may be affected by the subject litigation, you are directed pursuant to Section 27 of the Insurance Law to review your records for the years 1972 to 1980 regarding reinsurance cessions placed with or through any of the following:
Promotora De Occidente S.A. (Panama)
Promotora De Occidente S.A. (Mexico)
Promotora De Occidente (New York) Ltd.
C.J.V. Associates, Inc.
S.R.M.C. Management Corp.
M.I.R. Insurance Brokers Ltd, (England)
If cessions were made for the years in question, please provide this Department with the following information by calendar year for each cession:
a. Date of transaction, place and term
b. Type of cession
c. Assuming insurer
d. Intermediary name and address, if any
e. Total gross premium ceded
f. Ceding commission percentages (company and/or intermediaries)
g. Net premium ceded
h. Net premium paid
i. Party to whom premium payment was made
j. Recoverables, (e.g., paid losses, outstanding losses, unearned premiums, etc.) receivable or due your company, if any
k. Security (e.g., letters of credits, cash or securities) held by you for recoverables due.
You are also directed to provide this Department with copies of any treaties, certificates of insurance and/or reinsurance, statements of account and other documents received by your company with respect to business ceded to the above named parties.
In addition to the foregoing, if your company assumed any business, as retrocessionaire or otherwise, from any of the above named parties, you are directed to submit similar data with respect to such business assumed.
Reports are to be submitted to this Department within 10 calendar days of the date of this letter. If your company did not engage in any transactions with the above named parties, a statement to that effect is required to be submitted. Direct your reports to the attention of:
