Fire Insurance Fee – Section 9108

Section 9108 of the New York State Insurance Law requires that every insurance company authorized to do business in New York State collect, in addition to the applicable premium charge, a fire insurance fee, separately identified and charged to each policyholder, from each such holder of a policy issued in the state or for delivery in the state for coverage of peril of fire, excluding a policy for protection of household furnishings and/or policies issued to protect one or two-family residential structures, schools, churches and hospitals.

Payment Schedule

Fees are paid quarterly by insurance companies to the Department, after deducting from such gross premiums, (i) premiums upon policies not taken and (ii) premiums returned on cancelled policies, as follows: April fifteenth, July fifteenth, October fifteenth, and January fifteenth to reflect the net collections for the quarters ending March thirty-first, June thirtieth, September thirtieth, and December thirty-first, respectively.

Annual Fee Exhibit

Insurance companies are also required to complete and submit the Fire Insurance Fee Exhibit as a part of the New York Supplement to the Annual Statement.

Filing Options

Insurance companies that wish to submit the Fire Insurance Fee online, may do so via the Department's secure portal or through the Online Premium Tax for Insurance system (OPTIns) system offered by the National Association of Insurance Commissioners (NAIC).

If you have been pre-loaded into the DFS Portal, you should have received an email containing the instructions and information you will need to get started. If you did not receive an email, create a Portal account, and use the 'Ask for Apps' button to request access to the Fire Insurance Fee application.

Paper Form

Insurers unable to access the portal should submit Form OFM-5 (Fillable PDF) along with required fees. This form should also be used to submit amended filings.
