Volume of Servicing Report (VOSR) Filing Instructions

Section 597 of the New York Banking Law (NYBL) and Section 419.12 of Part 419 of the Superintendent Regulations requires registered mortgage loan servicers and exempt mortgage loan servicers regulated by the Department to file quarterly and other reports in the form prescribed by the Superintendent. In order to facilitate compliance with the filing requirements of Section 419.12, the Department has developed the Volume of Servicing Reporting System (VOSR).

Portal Applications and Accounts

VOSR Administrator:

All Regulated entities required to submit a VOSR pursuant to Section 419.12 must designate a VOSR Administrator responsible for creating the company's VOSR Administrator access account, designating sub-users, and submitting the completed report. The VOSR Administrator will also function as the primary VOSR contact with the Department. Designated Administrators must have sufficient authority to complete the VOSR affidavit and address compliance and VOSR related supervisory issues with the Department.

General Instructions - First Time VOSR Filers

  1. The designated Administrator must log into the portal in order to create an administrator account.
  2. Email will be sent to the Administrator to confirm or reject access to the VOSR Reporting System.
  3. Once account access is confirmed/approved by the Department, the Administrator can designate sub-users to input VOSR data. Note: Only the Administrator can submit the completed Report.

AFFIDAVIT/ATTESTATION: The owner or principal officer authorized to submit this report will be attesting to the financial figures submitted in Sections D through G. The attestation does not apply to Sections A and B as this information is pre-filled by the Department and may not reflect the current information for the Registrant.

Annual and Quarterly Filing Deadlines

Once the VOSR system opens for filing, registered and exempt MLS are expected to complete their quarterly and annual reports. Quarterly reports must be submitted no later than 30 days after the end of each reporting period. Annual reports must be submitted within 60 days of the respective calendar year-end.
