External Appeals

Consumers have the right to an external appeal in certain cases where health care services are denied by an HMO or health insurer. Providers have their own right to an external appeal when these health care services are denied concurrently or retrospectively. External appeal requests must be submitted to the New York State Department of Financial Services and the Department will assign independent medical experts to review the appeal. Legal Inquiries

The Office of General Counsel (OGC) is the legal arm of the DFS and drafts and reviews legislation, regulations and circular letters; conducts disciplinary and other hearings; issues legal opinions; and renders legal advice to DFS staff.
