Safeguarding Healthcare for All New Yorkers

As the many consumers who DFS has heard from know, the Trump Administration has taken another misguided and shortsighted action to dupe healthcare consumers into giving up life-saving comprehensive insurance benefits.  DFS has stated unequivocally that a 364-day health plan is not a short-term policy but a fiction that is nothing more than an end-run around the Affordable Care Act to further sabotage our existing health insurance marketplace.  Far from a promise of more affordable health insurance options, “skimpy” plans are a betrayal of the American people – particularly those with preexisting conditions and the elderly – that will entice people to buy junk insurance that provides little in the way of genuine coverage and will drive up rates by eroding membership in existing plans.  DFS will continue to protect both consumers and our health insurance markets by ensuring that short-term policies remain prohibited in New York and that New Yorkers continue to have access to affordable essential health services, including mental health services. 

Understanding Federal Actions

The Affordable Care Act (ACA) was enacted in 2010 to provide health insurance for people who otherwise would not have healthcare coverage. The current federal government has vowed to repeal and replace the ACA, creating uncertainty and concern for millions of Americans, including hundreds of thousands of New Yorkers and their families.
